01Who the controller is

We have not appointed a data protection officer: this website's activity does not fall under any of the cases listed in Article 37 of the GDPR.

02What data we process

Only what you give us of your own accord through the contact form:

• Name
• Phone number
• Email address
• Any message you choose to add
• The language you were browsing in, so we reply in it

03Data generated by browsing itself

The hosting provider keeps technical details of each connection in the server logs: IP address, browser type, and date and time. They exist to keep the service running and to spot security incidents, and we do not cross-reference them with the form data.

We collect nothing else. This website sets no cookies and uses no analytics tools, as set out in the cookie policy.

The data you give us should be yours and accurate. If you send us someone else's details, you must have told them first.

04What we use it for, and on what legal basis

To answer your request and send you the brochure with floor plans, areas, full specification and purchase terms. The legal basis is your consent, given when you tick the box on the form (Article 6(1)(a) GDPR), and the pre-contractual steps you asked for (Article 6(1)(b)).

To keep in touch about this same development: answering your questions, calling you, and letting you know about changes in availability or price. The legal basis is that same consent, also for the purposes of Article 21 of the Spanish LSSI.

To defend ourselves against possible claims, for which we keep a record of the request and of the consent given. The legal basis is our legitimate interest (Article 6(1)(f) GDPR).

We do not profile you or make automated decisions with your data, and we do not use it to promote projects other than this one without asking you first.

05How long we keep it

For as long as your interest in the development is alive, and at most 24 months from the last contact. After that we delete it.

If you withdraw your consent, we stop processing your data straight away. We only keep what is strictly necessary, blocked, while legal liabilities could still arise; once the limitation periods have passed, it is erased.

06Who else sees your data

We do not sell or share your data. It is only accessed by the providers we need to operate, which act as processors and are bound by contract under Article 28 of the GDPR:

• Formspree, Inc., which receives the form and delivers it to us by email.
• DonDominio, which hosts the website, the email and the server's technical logs.

07Transfers outside the European Union

The website and the email are hosted in Spain, inside the European Economic Area. The only data that leaves the Union goes to Formspree, Inc., based in the United States, which is what receives whatever you type into the form.

That transfer relies on their certification under the EU-US Data Privacy Framework or on the standard contractual clauses approved by the European Commission, with any additional measures required. If you want a copy of the safeguards in place, ask us at info@capmartinet70.com.

We may also disclose data to public authorities and courts where a legal rule requires it.

08Your rights

The GDPR gives you these rights, and you can exercise them whenever you want:

• Access: find out what data of yours we process and why.
• Rectification: correct anything inaccurate or incomplete.
• Erasure: ask us to delete it.
• Objection: ask us to stop processing it.
• Restriction: ask us to keep it only to handle claims.
• Portability: receive it in a readable format, or have us send it to another controller.
• Withdraw your consent at any time, without affecting the lawfulness of processing before then.

09How to exercise them, and where to complain

Write to info@capmartinet70.com saying which right you want to exercise and attaching a document proving your identity. We will reply within one month at the latest.

If you think we have not handled your request properly, you can complain to the Spanish Data Protection Agency (Agencia Española de Protección de Datos, C/ Jorge Juan 6, 28001 Madrid, www.aepd.es). Do write to us first if you like: most things are sorted out on the first try.

10Security

We apply the technical and organisational measures required by Article 32 of the GDPR: the site is served encrypted over HTTPS, access to the forms we receive is limited to the people who have to handle them, and we review the providers involved regularly.

No system is infallible. If a breach occurred that put your rights at risk, we would tell you and notify the supervisory authority within the deadlines set by Article 33.

11Children

This website is not aimed at children under fourteen and we do not knowingly collect their data. If we find we have received a minor's details without the authorisation of whoever has parental responsibility, we will delete them.

12Changes to this policy

We may update it if the way we handle data changes, or if a change in the law requires it. The date of the last revision appears at the top, next to the title.
